==========================================================================================

O believers! You have been prescribed the fast, as has been prescribed to those before you, so that you may attain piety. This, for a given number of days. Any one of you who is sick or traveling, will have to fast an equal number of other days. But for those who can not bear it (except with great difficulty), there is a compensation: to feed a poor man. And if someone does more of his own free will, it is good for him; But it is better for you to fast; if you knew ! It was during the month of Ramadan in which the Quran was sent down as a guide for people, and clear evidence of good direction and discernment. So whoever of you is present in this month that he fastes! And whoever is sick or traveling,

He later fasts an equal number of days. Allah wants for you the facility, not the difficulty, so that you may complete the number of days and proclaim the greatness of Allah for guiding you, and that you may be grateful. (Surah 2: The Cow – verses 183 to 185)

Therefore, the Prophet (peace and blessings of Allaah be upon him) said: ” Islam is founded on five pillars: the attestation that there is no other god worthy of worship but Allah And that Muhammad is his messenger, the fulfillment of the prayer, the acquittal of the zakat, the pilgrimage to the house of Allah, and the fasting of Ramadan . “

==========================================================================================

The obligation to fast Ramadan was established by the consensus of all Muslims. Thus, any Muslim who denies or rejects this obligation to fast the month of Ramadan is considered apostate and unbeliever. The person will be asked to repent; If she repents and accepts the obligatory status of Ramadan fasting, she will be considered Muslim. On the other hand, if she persists in disbelief, she will face the death penalty for apostasy.

The fasting of the month of Ramadan was prescribed in the second year following the emigration of the Messenger of Allah. The prophet (praise and salvation be upon him) fasted nine times the month of Ramadan during his lifetime.

This fast is an obligation for every Muslim puberty and endowed with reason.

==========================================================================================

Indeed, the disbeliever is not required to fast, and his fast will not be accepted by Allah until he has embraced Islam.

Similarly, children are not required to fast until they are pubescent. Puberty is reached at the age of fifteen years unless before that age the pubic hair appear, or an ejaculation occurs after a dream or other. We add to this the appearance of menstruation for the girl.

If one of these phenomena occurs in children, it will be considered puberty.
However, children should be prescribed to fast if they can bear it without difficulty so that they can get used to it and be tame to this adoration.

People with madness, the mentally handicapped, etc. Are not required to fast. Similarly, very old people whose behavior is meaningless and who no longer discern are not required to fast and pay compensation in food.

The Ramadan Fasting Statute

==========================================================================================

The fasting of Ramadan is a religious obligation under the Quran, the Sunnah, and the community consensus.

Concerning the Quran:

God the Almighty said:

“O you who have believed! Fasting has been prescribed to you as it has been prescribed to those who have gone before you; Maybe you will show yourself pious “Surah The Cow; Verse 183.

He also said:

“The month of Ramadan, the month of fasting, in which the Qur’an began to be revealed, guidance to people and evidence of good leadership and discernment. Let those of you who are present at the announcement of the holy month accomplish fasting! Surah The Cow; Verse 185.

==========================================================================================

Concerning the Sunnah:

The Prophet – on him the graces and peace – said:

“Islam is built on five pillars: to recognize that there is no other deity apart from God and that Muhammad is the Messenger of God, to fulfill prayer and legal alms, to observe The fasting of Ramadan, and accomplish the pilgrimage to Mecca for whoever can. ”

==========================================================================================

Talha Ibn ‘Ubaydullah is quoted as saying:

“A man came to find the Prophet – peace and grace – and said,” O Messenger of God, tell me the fast that God has commanded me. “This is the month of Ramadan,” replied the Prophet. “Do I have to fast for other days of the year?” “No,” replied the Prophet, “unless you do it voluntarily.” ”

==========================================================================================

We implore Allah to accept our fast and to fill us with His Clemency and Mercy during this blessed month of Ramadhan.

The status of one who sells food during the days of Ramadan

==========================================================================================

How to judge the sale of food during the Ramadan days in a shop or a grocery store? I live in Russia where most people do not observe fasting. I read on your site that it is forbidden to open a restaurant or a bar because the customers come to eat there. I sell food, especially dumplings, bread and rice in a shop. I do not know when my clients consume what they buy but I strongly believe they do not observe fasting. It is also possible that they consume the products purchased after sunset or at this time or shortly thereafter.

==========================================================================================

Praise be to Allaah

Foods can be sold in the shop or grocery store under two categories, each of which has its status.
The first category is made up of foods that are believed to be consumed by the buyer as soon as they are purchased because they are fast-food items. It’s like frozen foods, ice creams, juices and fresh or hot drinks to eat right away or snacks made for immediate consumption and other similar foods. The Muslim is not allowed to sell such commodities during a Ramadan day because it is strongly believed that the one who buys them will violate the sanctity of the virtuous month by consuming them. It does not matter whether the buyer is Muslim or not because non-Muslims are also concerned by the orders relating to the secondary aspects of Sharia. It is not permissible to help them to commit sin and transgression since Allah Most High says, “Help each other in the performance of good works and godliness and do not help each other in sin and transgression “(Qur’an, 5: 2).

==========================================================================================

==========================================================================================

The chafiite, the Imam ar-Ramli (may Allaah have mercy on him) wrote: “An illustration is given by the fact that a Muslim gives food to a disbeliever during a day of Ramadan. It is the same with selling a food to him while knowing or strongly believing that he will consume it in the day according to a notice issued by our father (may Allah grant him His mercy). Indeed, To act in this way is tantamount to provoking and facilitating an act of disobedience according to the opinion of those who consider that the disbelievers are responsible for the secondary aspects of the Shari’a, which remains the best argued. Extract from Nihatoul mouhtadj , (3/471).

Sheikh Ibn ‘Uthaymeen (may Allaah have mercy on him) said: “It is not permissible to open the restaurants to welcome the disbelievers (who, of course, remain closed to Muslims) during the Ramadan days. You who find a restaurant open during a day of Ramadan must inform the competent authority to have it closed. No disbeliever is allowed to eat or drink publicly during a day of Ramadan in a Muslim country. We must forbid it. »Extract from al-liqaa ach-chahri , 4/8) according to the automatic numbering of the chamailla.

In the fatwas of the Permanent Commission (2/9/36), it is stated: “It is not permissible to open a restaurant during a Ramadan day to welcome unbelievers and offer them services. Serious religious apprehensions, including helping others to violate Allah’s prohibitions. For it is well known that the purified law applies in its principal and secondary aspects to the disbelievers. There is no doubt that fasting is one of the pillars of Islam and that they (the disbelievers) must observe it when they fulfill the condition of conversion to Islam. Therefore, the Muslim is not allowed to help them not to do what Allah has commanded them. Nor is it permissible to serve them in a humiliating manner for the Muslim by offering them a meal or other similar services. We must impose on the disbelievers present in Muslim countries the abandonment of any activity contrary to the rites of Islam and likely to harm the Muslims and to hurt their feelings.

The status of this category has already been confirmed in the answer given to question No. 78494 and in the answer given to question No. 49694 .

==========================================================================================

The second category includes foods that the seller knows the time of consumption and knows that if it is during the day or at night. This is the case with canned foods, packaged sugar, bread and all the commonly used products such as oil, rice and consort (in short) the most sold products on the market to our knowledge. There is no disadvantage that the Muslim sells them during the days of Ramadan. He does not commit any sin in doing so.

It is true that the seller may strongly believe that the buyer does not observe fasting because the disbeliever or lax Muslim but he may not know why the customer buys the product. The latter can use it immediately or later. Moreover, he can even lose it purely and simply. In addition, there is no general status or description applicable to all products purchased. No one could tell precisely if most buyers consume the products during the day or night. The question remains absolutely open.

Therefore, the principle of the lawfulness of their sale remains undoubtedly. The domain is not concerned with the prohibition of cooperating in the commission of sin and in transgression because no one can assert with certainty that the purchased goods will be used in a way that involves sin and transgression. However, the status quo involving licit can only be changed if there is a safe and convincing argument. This assertion is discovered in the limitation quoted by ar-Ramli earlier when he said: “It is the same with the sale of food to a disbeliever while knowing or strongly believing that he will consume them during the day . ”

About the second category, it is assumed that the seller does not know and does not believe that the customer will consume the product during the day in Ramadaan. Since the cause of the prohibition is not verified, the lawfulness remains. This is what applies to any sale when you doubt the use that the buyer will make of the object.
Ar-Ramli (may Allaah have mercy on him) also says: “He who attributes to the majority (of the scholars) the opinion in the direction of a lawful with reprobation hears the presence of doubt.” Of Niahtoul mouhtadj (3/471).

==========================================================================================

==========================================================================================

The majority that supports the lawful in these cases hears of lawful despite the existence of doubt, so the case in which the seller does not know the drawing of the buyer. Ar-Ramli (may Allaah have mercy on him) also says: “He who attributes to the majority (of the scholars) the opinion going in the direction of a licit and with reprobation hears about the presence of doubt.” Of Niahtoul mouhtadj (3/471). The majority that supports the lawful in these cases hears of lawful despite the existence of doubt, so the case in which the seller does not know the drawing of the buyer. Ar-Ramli (may Allaah have mercy on him) also says: “He who attributes to the majority (of the scholars) the opinion in the direction of a lawful with reprobation hears the presence of doubt.” Of Niahtoul mouhtadj (3/471). The majority that supports the lawful in these cases hears of lawful despite the existence of doubt, so the case in which the seller does not know the drawing of the buyer.

Moreover, Islamic law does not impose excessive rigor on people and only asks them what they can bring. The intent of each buyer would obviously be excessively rigorous and unrelated to the required facilitation. That Allah the Mighty and Transcendent does not approve because he said: “Allah does not impose on any soul a charge superior to its capacity” (Qur’an, 2: 286) and says “Allah wants for you the facility, Do not want the trouble for you “(Quran, 2/185).

The second category can not be equated with the prohibition of the sale of the grapes to the one which will transform it into wine, since consumption of the grapes is prohibited in all cases. The one who sells reason to a disbeliever can strongly believe that the customer will make the product a use contrary to the order of Allah.

Allah knows best.
